4/17/09 - Update - ATU Local 1395 Local Union President Mike Lowery sent ECAT General Manager Ken Gordon an email on 4/16/09 that the Company missed the time limit to respond to a grievance hearing held on Monday, April 6th.  GM Gordon had till close of business Monday, April 13th to respond.  Lowery's email states since the time limit has been missed the grievance (for Bus Operator Faye Carroll) should be awarded.  Gordon has not responded to Lowery's position. 

The grievance was filed for Operator Carroll.  The Union contends that under the collective bargaining agreement it allows for modified duty up to 12 weeks after all leaves, FMLA, and short-term disability have been exhausted.  The Company originally took the position that this provision in the labor agreement was only for workers' compensation.
